TRENTON, Ga. — A Superior Court judge will be asked to determine if Brenda McKaig is still a member of the Dade County Board of Tax Assessors.
Earlier this month, the Dade County Commission learned Ms. McKaig had failed to complete training the state mandates for certification as a voting member of the board.
Commissioners, during a special called meeting Friday evening, voted unanimously to refer the matter of Ms. McKaig’s qualification to the court.
County Attorney Robin Rogers said the meeting was called after the certification issue “came to our attention.”
By law, to be certified each newly appointed member of the board of tax assessors must complete 40 hours of instruction within 180 days of his or her appointment. To retain certification, similar training must be completed every two years.
“We’ve never had this happen before,” board Chairwoman Hazel Doyle said. “We thought everything was fine.”
Ms. McKaig served on the board from 1999 until resigning her position in 2007. When reappointed in July 2008, Georgia Department of Revenue regulations required she, as a new member, complete the 40-hour course within 180 days. She did not.
“Any action taken by a non-certified member would not be negated,” said Charles Willey, spokesman for the Department of Revenue, meaning votes by Ms. McKaig since she became disqualified will not be voided.
Commissioners had some options, according to Mr. Rogers. They could allow Ms. McKaig to complete her training while serving on the board, could accept her resignation and appoint a replacement, or ask a judge to decide if she is qualified to serve.
Meanwhile, county commissioners appointed Donny Williams to fill a vacancy on the five-member board of tax assessors that resulted when Howard Doyle, no close relation to the chairwoman, resigned two weeks ago.
